Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Amiplay advertising platform, including the website amiplay.net and the dashboard at adserv.amiplay.net (together, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity that occurs under your account.

2. Advertisers

  • Advertisers may join from anywhere in the world. The platform operates on a prepaid balance, with a minimum top-up of USD $10 to begin.
  • You are responsible for your creatives, landing pages, targeting choices and budgets, and for ensuring your campaigns are lawful in the locations they target.
  • Amounts spent on delivered impressions, clicks or conversions are non-refundable except where required by law or expressly stated by us. We do not guarantee any specific result, volume or return.

3. Publishers

  • Publishers must own or be authorized to monetize the properties they submit, and must meet a minimum of 5,000 genuine page views per day.
  • Traffic must come from real human visitors. Artificially generated, incentivized, bot or otherwise invalid traffic is strictly prohibited.
  • Earnings are calculated on valid, billable activity. We may withhold, adjust or reverse earnings associated with invalid traffic, fraud, or breach of these Terms. Payouts are made on our standard schedule once any applicable minimum threshold is met.

4. Acceptable content & prohibited categories

To protect advertisers, publishers and end users, we do not accept advertisers or publishers whose campaigns, sites or apps involve:

  • Adult or pornographic content of any kind;
  • Gambling, betting, casino or related content;
  • Any illegal, fraudulent, deceptive or harmful activity, including malware, phishing, infringing or counterfeit goods, hate speech, and the promotion of prohibited or regulated products.

We may refuse, suspend or remove any account, campaign, site or creative that we reasonably believe breaches these standards, and may withhold related balances or earnings. We may update the list of restricted categories at any time.

5. Payments & taxes

All fees and balances are stated in US dollars unless otherwise noted. You are responsible for any taxes, levies or fees imposed by your jurisdiction. We may use third-party payment processors; their terms may also apply.

6. Acceptable use

You agree not to misuse the Services, including by attempting to disrupt or reverse-engineer the platform, circumvent fraud controls, generate invalid traffic, or violate the rights of others or any applicable law.

7. Intellectual property

The Services, including all software, designs, logos and content provided by Amiplay, are owned by Amiplay or its licensors and are protected by law. You retain ownership of the content and creatives you provide and grant us a limited license to host, display and distribute them as needed to operate the Services.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, availability, or uninterrupted or error-free operation.

9. Limitation of liability

To the maximum extent permitted by law, Amiplay will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Services will not exceed the amounts you paid to, or were owed by, us in the three months preceding the event giving rise to the claim.

10. Suspension & termination

We may suspend or terminate your access to the Services at any time for breach of these Terms or to protect the platform and its users. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws applicable at Amiplay's principal place of business, without regard to conflict-of-law rules. Nothing here limits any mandatory consumer rights you may have under local law.
